The estate owner’s designated personal representative can retain a probate attorney to help them fulfill their legal duties. These duties include accounting for the decedent’s assets to the court and beneficiaries, settling their lawful debts, and distributing their assets to named heirs and beneficiaries.

The fees a probate lawyer receives are limited by statute and tied to the gross value of the decedent’s estate. The value doesn’t include any debts the decedent may owe that would also be paid out of the estate’s assets. A probate lawyer's final compensation is subject to the court’s approval.

In certain situations, a probate lawyer can request and receive fees for services that go above and beyond the routine tasks they’re expected to complete. These additional fees could cover activities like defending the estate against will contests or addressing situations like a personal representative who dies or becomes incapacitated.

If you’re the personal representative of a deceased loved one’s estate and you decide to rely on a probate lawyer’s services, the cost of those services will come out of the value of the estate’s assets. Personal representatives typically aren’t responsible for paying their legal fees themselves.

The fees and costs associated with probate in California include more than just the initial filing fee. Personal representatives and probate law firms are also entitled to compensation for their services. If appraisals or other professional services are required, the fees for these services can add to the cost of probate as well.

First, California courts charge a fee of $435 to commence a probate case. This fee represents the cost of opening the case in the courts and doesn’t offset any other fees that might be incurred during the case. If the individual filing is experiencing financial hardship, the court may consider waiving this fee.

Next, California statutes entitle personal representatives and probate lawyers to compensation for their services. In ordinary situations, these individuals are entitled to fees calculated as a percentage of the estate’s overall value. The greater the value, the higher the final payout will be.

If unusual situations make administering the estate more difficult or time-consuming, the lawyer can seek further payment for these additional services. These fees will be paid in addition to the ordinary fees authorized by state statutes.

Lastly, there may be situations in which the personal representative needs to seek the services of experts, appraisers, or other professionals. The fees these individuals charge for their services aren’t included in the standard approved legal fees or the court filing fee.

The total cost of probate will depend primarily on the estate’s value and the complexity of administering it. However, these costs are paid from the estate’s assets, not the representative’s personal finances.

Not every estate is subject to the formal probate process in California. For example, those with a value of less than $166,250 can go through a simplified process instead of the formal probate procedure. Any estate worth more than $166,250, however, must go through probate.

An estate’s value is determined by considering the value of the decedent's personal and real property. This included homes, land, jewelry, artwork, collectibles, and the value of any bank accounts. The value of any property held in joint tenancy with another person may also be considered when arriving at an estate’s value.

Just because an estate’s value falls below $166,250 doesn’t mean it will necessarily avoid probate.

Formal probate proceedings may be required if the decedent leaves a will and a beneficiary or another interested party contests its validity. Similarly, probate may be necessary to resolve disputes between the personal representative and the estate’s heirs or beneficiaries.
